Hello All, As you have probably read before, Senate Bill 196 is a bill that will limit landowner liability when they open private lands for recreational use. This will allow many large landowners to open their lands to mountain biking, hiking, etc. This bill is great for us as we are a low to no impact sport and I feel like we will be able to get access to a lot of land that ATV's won't be able to gain access to as what activities are allowed are left completely up to the landowner. Please take a moment of your time and contact the members of the 2008 House Standing Committee on Tourism Development and Energy which can be found at the link below: http://www.lrc.ky.gov/committee/Standing/TD&E(H)/members.htm Speak to the economic impact this will potentially have, as well as opening up land that many kentuckians would never otherwise have the ability to see. This will only take a moment of your time and will make a huge difference. Please focus on the members of this committee for now and after it makes it out of committee we will need to hit all of our reps hard to secure their support. Let me know if you have any questions. The Bill came out of Committee today, looks like it might hit the house floor tomorrow. Call your rep's if you have the time, I think we'll get it through.

Today is the day folks, take a moment to potentially make a positive impact, I can't imagine this not passing the house today but it never hurts to have some additional padding. PLEASE make those calls.

Passed 99-0. Will go back to Senate for concurrence, hopefully tomorrow. Finally some progress, I can see this didn't go over to great fan fare. Guess the horse folks must have taken the time to call...interesting.

Pat, I think this thing has been good to go since it was introduced. (Gee, I hope I did'nt just jinx it!) This thing addresses the landowner liability ("hold harmless") and probably had alot of coal/oil company interest due to their huge holdings in eastern ky. Call me a cynic, but that likely had more effect than us mtbrs, and the equestrian crowd too!

Actually the horsey crowd is what got this moving, Mrs. Beshear is a horse person and he spoke on behalf of this bill in the house, along with the Lt. Gov. We have been toiling with this legislation for over a year in the KRTA going through multiple versions, drafts, etc. and the timing was right to pounce. I didn't see anyone from coal etc. at any of the committee meetings, nor did I hear any mention of them. I testified to the Senate Energy and Natural resources committee on behalf of the 2 wheel crowd, that was a cool experience that I'm glad I had the opportunity to do. Our sponsors, Brandon Smith in the Senate and Robin Webb in the house both deserve a lot of thanks. This bill will result in a good bit of additional riding opportunities in our state, especially in areas where there isn't much govt owned land. Either way, this one got pushed through but the next one may not we need to speak with a unified and powerful voice. Just ask anyone in frankfort if they know the KMA (KY Motorcycle Association) and every elected official will say yes because they walk LOUDLY and carry a big stick they are relentless with their calling, visits, etc.

There may have been some behind the scene support. Two or three of the counties that already have the big atv routes (soon to be adv tourism trails) run across a ton of private holdings that are both company owned, and private landowners. The actual number of private landowners is greater than the number of company holdings, but in the actual area(s) involved, the companies own much more of the land. So several counties (and several big companies) already had a vested interest in this. That never hurts!
